The Ministry of Information and Broadcasting (MIB) has intensified its stance against the proliferation of offshore betting and gambling advertisements. In a recent advisory, the Ministry directed all media entities, including social media platforms and online intermediaries, to immediately refrain from publishing or telecasting advertisements of offshore betting platforms. This directive extends to surrogate advertisements—where betting sites are promoted under the guise of news or sports websites.
The government’s intervention is rooted in the fact that betting and gambling are illegal activities in most parts of India. Under the Public Gambling Act, 1867, and various state-specific legislations, these platforms operate without legal sanction. The MIB highlighted that such advertisements not only violate the Consumer Protection Act, 2019, but also the Cable Television Networks Regulation Act, 1995, and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
