Balancing Transparency and Security: Reassessing RTI Exemptions in State Governance

The recent decision by the Tamil Nadu government to withdraw an order exempting the Public (Law and Order) Department from the purview of the Right to Information (RTI) Act, 2005, marks a significant victory for transparency and democratic accountability. The initial move, which sought to classify the department as an 'intelligence and security organization' under the Second Schedule of the RTI Act, had sparked widespread criticism from civil society groups and political stakeholders. Critics argued that such a classification was an overreach, potentially shielding the administrative wing of the police department from public scrutiny and undermining the foundational spirit of the RTI Act. The RTI Act is a cornerstone of Indian democracy, designed to empower citizens, promote transparency, and curb corruption. While Section 24 of the Act does allow for the exemption of intelligence and security organizations to protect national sovereignty and sensitive operational data, this provision is intended to be used sparingly.
