Strengthening Digital Accountability: OTT Platforms and the IT Rules, 2021

The digital landscape in India has witnessed an unprecedented surge in Over-the-Top (OTT) media consumption. To ensure that this growth does not come at the cost of social harmony or ethical standards, the government has reiterated that OTT platforms must strictly adhere to the Code of Ethics prescribed under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

This regulatory framework serves as a vital instrument for balancing the freedom of expression with the need for responsible content delivery. The Code of Ethics mandates that platforms exercise due diligence in content classification, ensuring that age-appropriate ratings are displayed and that content does not violate national sovereignty, public order, or decency. By establishing a three-tier grievance redressal mechanism—ranging from self-regulation by the publisher to an inter-departmental committee at the government level—the rules aim to foster accountability in the digital media space.

From an ethical perspective, this development highlights the tension between creative autonomy and the state's duty to protect vulnerable sections of society, particularly children, from harmful content. It underscores the principle that in a democratic setup, rights are not absolute and must be balanced against the collective interest.
