Strengthening Jurisprudential Frameworks for Infrastructure Development: The Role of Rule of Law

At the 2026 FIDIC Global Infrastructure Conference, Chief Justice of India Surya Kant articulated a compelling vision for the intersection of law and national development. He emphasized that the 'Rule of Law' is not merely a constitutional principle but a functional prerequisite for the success of large-scale infrastructure projects. In an era where India is aggressively pursuing its infrastructure roadmap, the judiciary’s focus on contractual sanctity and institutionalized dispute resolution is timely. Project delays in India are frequently attributed to protracted litigation, ambiguous contractual obligations, and regulatory bottlenecks. The CJI’s address highlighted that when public interest is at stake, the legal system must act as an enabler rather than a hurdle. By advocating for standardized, robust contractual frameworks, the judiciary aims to mitigate the risks associated with public-private partnerships (PPPs). Such mechanisms are essential to prevent cost overruns and ensure that public funds are utilized with maximum efficiency, thereby fostering investor confidence and long-term economic stability.
